We successfully advised Brook Street UK Ltd in a claim against the National Exhibition Centre Ltd (the Birmingham NEC) for circa £1million.
Brook Street supplied temporary staff to the London Olympic and Paralympic Games 2012. The temporary staff were in the main supplied to Olympic Park North but there were a small amount of staff supplied to Amadeus’s logistic hub at the NEC in Birmingham.
Following the closing ceremony of the Paralympics Games, Amadeus failed to pay Brook Street’s invoices, circa £1million. We issued proceedings on behalf of Brook Street to recover the money owed.
Amadeus defended the claim on the basis of alleged failure to vet the temporary staff in accordance with the requirements of the London Organising Committee of the Olympic and Paralympics Games Ltd.
The parties had not signed a contract that incorporated these requirements and Brook Street had been notified of much simpler requirements which it had complied with. It was Brook Street’s case that its standard terms and conditions of business applied as modified by those simpler requirements.
